DISTANCE SALES AGREEMENT

1. PARTIES

This Agreement is executed between the following parties under the terms and conditions specified below:

A. 'BUYER'; (hereinafter referred to as "BUYER" in the agreement)

B. 'BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.'; (hereinafter referred to as "SELLER" in the agreement)

By accepting this agreement, the BUYER acknowledges in advance that they will be obligated to pay the order amount and any additional fees such as shipping and tax if the order is approved.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the following terms shall have the meanings assigned to them below:

MINISTER: The Minister of Customs and Trade,

MINISTRY: The Ministry of Customs and Trade,

LAW: The Law on the Protection of Consumers No. 6502,

REGULATION: The Distance Contracts Regulation (OG: 27.11.2014/29188),

SERVICE: Any consumer transaction other than providing goods, which is carried out or committed to be carried out in exchange for a fee or benefit,

SELLER: The company offering goods to the consumer or acting on behalf or account of the supplier within the scope of its commercial or professional activities,

BUYER: The real or legal person who acquires, uses, or benefits from a product or service for non-commercial or non-professional purposes,

SITE: The website owned by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.,

ORDERING PARTY: The real or legal person who places an order for a product or service via the website of BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.,

PARTIES: BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. and the BUYER,

AGREEMENT: This agreement executed between BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. and the BUYER,

GOODS: The movable property subject to shopping and intangible goods prepared for use in the electronic environment, such as software, sound, image, and similar.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product, the specifications and sales price of which are indicated below, that the BUYER has ordered electronically via the website of BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.

The listed and announced prices on the site are the sales prices. The announced prices and promises remain valid until updated and changed. The prices announced for a limited period are valid until the specified period ends.

If a campaign has been organized by BAMOST, you can review the main characteristics of the relevant product during the campaign. The campaign is valid until the specified date.

7.2. The listed and announced prices on the site are the sales prices. The announced prices and promises remain valid until updated and changed. The prices announced for a limited period are valid until the specified period ends.

Invoice Delivery: The invoice will be delivered to the billing address along with the order during delivery.

9. GENERAL PROVISIONS

9.1. The BUYER accepts, declares, and undertakes that they have read the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product on the website of BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ., that they are informed about it, and that they have provided the necessary confirmation in the electronic environment. The BUYER accepts, declares, and undertakes that they have obtained the correct and complete information about the address to be provided by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. to the BUYER, the basic characteristics of the ordered products, the prices of the products including taxes, and the payment and delivery information before the execution of the distance sales agreement by confirming the Preliminary Information electronically.

9.2. Each product subject to the agreement is delivered to the BUYER or the person/organization indicated by the BUYER at the address provided by the BUYER, within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 30 days. If the product cannot be delivered to the BUYER within this period, the BUYER has the right to terminate the agreement.

9.3. BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. accepts, declares, and undertakes to deliver the product subject to the agreement in a complete manner, in accordance with the qualifications specified in the order, along with any warranty documents, user manuals, and other required information and documents, free from any defects, in accordance with the requirements of the legal regulations, in good condition, in accordance with the standards, and within the principles of honesty and integrity, to protect and improve the quality of the service, to show the necessary care and diligence during the performance of the work, and to act with foresight and caution during the performance of the work.

9.4. BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. may supply a different product of equal quality and price by informing the BUYER and obtaining their explicit approval before the fulfillment period of its performance obligation under the agreement expires.

9.5. If BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. is unable to fulfill its obligations under the agreement due to the impossibility of fulfilling the order, it accepts, declares, and undertakes to notify the consumer of this situation in writing within 3 days from the date it becomes aware of it and to refund the total amount to the BUYER within 14 days, deducting the return shipping fee as determined by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. during the campaign period and as specified.

9.6. The BUYER accepts, declares, and undertakes that they will confirm this Agreement electronically for the delivery of the product subject to the Agreement, and if the price of the product subject to the Agreement is not paid for any reason and/or is canceled in the bank records, BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. will be released from its obligation to deliver the product subject to the Agreement.

9.7. The BUYER accepts, declares, and undertakes that if the product subject to the Agreement is delivered to the BUYER or the person/organization at the address indicated by the BUYER, and the BUYER’s credit card is used fraudulently by unauthorized persons, and if the product price is not paid to BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. by the relevant bank or financial institution, the BUYER will return the product to BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. within 3 days, with the transportation cost to be borne by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.

9.8. BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. accepts, declares, and undertakes that if it cannot deliver the product subject to the agreement on time due to force majeure events that develop beyond the control of the parties, that were not foreseeable beforehand, and that prevent or delay the fulfillment of the parties' obligations, it will notify the BUYER of the situation. The BUYER has the right to request BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. to cancel the order, replace the product subject to the Agreement with its equivalent, if available, or postpone the delivery time until the obstacle is removed. If the BUYER cancels the order, the amount paid by the BUYER in cash will be refunded to them in full within 14 days. In the case of payments made by the BUYER via credit card, the product amount will be returned to the relevant bank within 14 days after the order is canceled. The BUYER accepts, declares, and undertakes that it may take 2 to 3 weeks for the bank to transfer the amount to the BUYER's account, and BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. is not responsible for any delays that occur due to the transfer of this amount.

9.9. BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.'s address, telephone number, and other contact information can be found on the website. In the event of disputes arising out of the Agreement, the BUYER may file a complaint and make an objection before the Consumer Arbitration Committee or Consumer Court where the consumer transaction is carried out or where the BUYER is located within the monetary limits determined by the Ministry of Customs and Trade in December each year. 10. RIGHT OF WITHDRAWAL

10.1. The BUYER has the right to withdraw from this Agreement within 14 days without any justification and without incurring any penalties, starting from the date the product is delivered to the BUYER or the person/organization at the address indicated by the BUYER. To exercise the right of withdrawal, the BUYER must notify BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. by email at iletisim@bamost.com or through the contact form on BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.'s website, within the 14-day period. The product must not have been used in any way within this period. If this right is exercised, the return shipping cost will be borne by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. if returned within the specified period. If the return shipping is not carried out within the specified period, the BUYER will bear the shipping cost. Within 14 days from the date of receipt of the notification regarding the withdrawal, the total amount received by BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ. from the BUYER for the relevant product will be refunded to the BUYER, including the cost of returning the product.

11. PRODUCTS THAT CANNOT BE USED FOR THE RIGHT OF WITHDRAWAL

11.1. The BUYER cannot exercise the right of withdrawal in the following cases:

a) Goods specially prepared based on the BUYER’s requests or clearly customized to their personal needs.

b) Perishable goods or goods that may expire.

c) Goods that are not suitable for return due to health protection or hygiene reasons and that are unsealed after delivery.

d) Goods that are mixed with other products after delivery and cannot be separated due to their nature.

e) Services provided instantly in the electronic environment or intangible goods delivered instantly to the consumer.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER fails to make payments for credit card transactions, the BUYER shall pay interest and be liable to the bank under the credit card agreement. In this case, the relevant bank may initiate legal proceedings; if the BUYER defaults, the BUYER agrees to pay damages and legal fees to BAMOST TEKSTİL DIŞ TİCARET LTD. ŞTİ.

13. SETTLEMENT OF DISPUTES

In the resolution of disputes arising from this Agreement, Turkish laws will apply, and Istanbul Consumer Arbitration Committees and Consumer Courts will have jurisdiction over disputes within the monetary limits set by the Ministry of Customs and Trade.

14. ENFORCEMENT

By placing an order through the website, the BUYER accepts all the terms and conditions in this Agreement. This Agreement becomes effective as soon as the BUYER completes the payment of the order placed through the website.
